1. Agreement

By accessing or using this website and any online features made available through it (collectively, the "Site"), you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you must not access or use the Site.

Ficha Group S.A. ("Ficha," "we," "us") may amend these Terms of Use from time to time by posting the amended Terms of Use on the Site. The amended Terms of Use take effect upon posting. Your continued access to or use of the Site constitutes acceptance of the amended Terms of Use.

We may, in our discretion, restrict, suspend, or terminate access to the Site at any time, to the extent permitted by law.

These Terms of Use govern your use of the Site only. Custody and other services require a separate written agreement.

In these Terms of Use:

  • "Content" means text, graphics, data, materials, and other content made available on the Site by or on behalf of Ficha.
  • "Third-Party Content" means content made available by third parties, including through links to third-party websites.

2. Our approach

Ficha operates with a long-term perspective. We do not pursue growth through aggressive marketing, promotional incentives, or urgency-based tactics. We do not offer lending, leverage, yield products, or speculative instruments.

These Terms of Use reflect that discipline: clear obligations, defined boundaries, no hidden conditions.

4. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and have legal capacity to accept these Terms of Use. If acting on behalf of an organization, you represent authority to bind that organization.

5. Jurisdictional restrictions

The Site is not intended for use where prohibited by law. You are responsible for compliance with local regulations.

  • United States: This Site does not constitute an offer to U.S. persons.
  • European Union and United Kingdom: Provided for informational purposes only unless otherwise stated.
  • Other jurisdictions: Verify that access is permitted under your local law.

6. Compliance

Ficha operates under Argentine law, including Law No. 25,246 (anti-money laundering) and regulations of the Unidad de Información Financiera.

You represent that you are not subject to sanctions under Argentine law or listed on the RePET or similar registries, and that you will not use the Site for any prohibited purpose. If you are a Politically Exposed Person under UIF regulations, enhanced due diligence may apply.

7. No offer, no advice

Nothing on this Site constitutes an offer to buy or sell bitcoin, a recommendation to open an account, or investment, legal, or tax advice. The Site does not consider your individual circumstances.

Consult independent professional advisors before making decisions. Ficha accepts no responsibility for decisions made in reliance on Site content.

8. No client relationship

Using this Site does not establish a client, advisory, or fiduciary relationship. Such relationships require a separate written agreement.

9. Bitcoin risks

Regulatory notice (CNV Resolution 927/2022): Bitcoin is not legal tender in Argentina, is not issued or guaranteed by any government, and is not regulated by the CNV or BCRA. Virtual assets carry significant risks including total loss of value. No investor protection schemes apply.

By accessing this Site, you acknowledge that bitcoin:

  • May fluctuate significantly in value, including substantial declines
  • Involves irreversible transactions and potential permanent loss
  • Is subject to technical risks, regulatory changes, and cybersecurity threats
  • Is not covered by deposit insurance or government guarantees
  • Carries uncertain tax treatment

10. Disclaimers

The Site is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.

We do not warrant that the Site will be accurate, complete, uninterrupted, secure, or error-free. Information may become outdated without notice. Market data is provided for reference only.

11. Limitation of liability

To the fullest extent permitted by Argentine law, Ficha shall not be liable for damages arising from your use of the Site or reliance on its content, whether such damages are direct, indirect, or consequential in nature.

This limitation applies irrespective of the legal basis of any claim and whether or not the possibility of such damages was foreseeable.

Nothing in these Terms of Use excludes or limits liability where such exclusion or limitation is prohibited by law.

12. Indemnification

To the extent permitted by law, you agree to indemnify Ficha against claims arising from your use of the Site, violation of these Terms of Use, or infringement of third-party rights.

13. Intellectual property

All Content is the property of Ficha or its licensors and is protected by Argentine and international law. You may view and print Content for personal, non-commercial use, provided you retain all proprietary notices.

You may not copy, distribute, modify, or create derivative works without written consent. Automated access for scraping or data extraction is prohibited.

14. Third-party content

The Site may include Third-Party Content. Ficha does not control, verify, or endorse Third-Party Content and disclaims responsibility for it. Third-party websites are subject to their own terms and policies.

15. Data processing

Ficha collects limited technical data for security, system administration, and compliance purposes. We do not use behavioral tracking, advertising cookies, or profiling tools.

Personal data is processed under Law No. 25,326 (Personal Data Protection). You have rights to access, correct, and delete your data. See our Privacy Policy for details.

16. Account security

If the Site provides access to account areas, you are responsible for safeguarding your login credentials, maintaining their confidentiality, and using reasonable security measures. You must notify us promptly at legal@ficha.com if you suspect unauthorized access, credential compromise, or any security incident related to your account.

17. Prohibited conduct

You agree not to use the Site unlawfully, attempt unauthorized access, interfere with system integrity, transmit harmful code, or misrepresent your identity.

18. Changes

Ficha may modify, suspend, or discontinue any aspect of the Site at any time. We do not undertake to maintain, update, or continue any Content, feature, or functionality.

19. Assignment

Ficha may assign or transfer its rights and obligations under these Terms of Use and may delegate performance to affiliates or service providers. You may not assign or transfer your rights or obligations under these Terms of Use without our prior written consent.

20. Severability

If any provision of these Terms of Use is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force.

21. Waiver

No failure or delay by Ficha in exercising any right under these Terms of Use shall operate as a waiver thereof.

22. Force majeure

Ficha shall not be liable for any failure to perform its obligations where such failure results from circumstances beyond its reasonable control.

23. Governing law

These Terms of Use are governed by Argentine law. Disputes shall be submitted to the courts of the Autonomous City of Buenos Aires, unless mandatory consumer protection rules provide otherwise.

Consumers under Law No. 24,240 may submit claims to COPREC before judicial proceedings.

24. Consumer rights

Nothing herein affects mandatory consumer rights under Argentine law. Where such provisions apply, they prevail.
